Sounds like a legal maxim to me. I imagine if we knew the L a**n for it, it could be found in Black's.

Seems to me related to:

"For when the law doth give any thing to one, it giveth impliedly whatsoever is necessary for the taking and enjoying of the same";
along with:

"an act in law shall worke no wrong"

IOW, what one normally could not do, may be permitted by the law.
